Kathmandu, Nepal: The Lawmakers from the ruling Nepal Communist Party (NCP) have been preparing to register the impeachment motion against senior most Supreme Court (SC) Justice Deepak Raj Joshee.

NCP Lawmakers, who have already collected the signatures for the purpose, have reached on the conclusion to register the impeachment motion after Joshi denied resigning from the post. 

According to a source, the NCP leaders had been sending a message to the justice Joshee through different means stating either to resign from the post or be ready to face the consequences like impeachment.

It is said that the lawmakers from the ruling NCP will register the impeachment motion within days or two to restrict him from any hearing.

The Supreme Court has already begun to assign him the duties. Joshee is free to discharge the duties in the capacity of the senior most Supreme Court justice. Likewise, he can discharge the responsibility as acting chief justice in case of necessary and represent to the constitutional council in the capacity of senior Supreme Court justice. 

However, neither the government nor the NCP lawmakers have spoken out officially over their plan to register the impeachment motion against Joshee. 

Though Joshee’s name was rejected as chief justice by the Parliamentary Hearings Committee on August 3, he had resumed his duties as justice on September 10, the day when newly-appointed Chief Justice Om Prakash Mishra took up office as Chief Justice. 

Political parties, particularly the ruling head NCP and the main opposition Nepali Congress had vertically divided over the issue of rejecting Joshee name from the parliamentary hearing committee. 

Lawmakers represent to the hearing committee from the main opposition Nepali Congress had boycotted the committee meeting after ruling party members insisted on rejecting Joshee's nomination. As government allies have two third majorities in the House of Representatives, Joshee can be impeached sans of Nepali Congress’s support.
