Kathmandu, Nepal, November 9, 2021: Agitating Supreme Court (SC) justices, who had been boycotting all the benches demanding the resignation of Chief Justice Cholendra Shumsher Rana, begins hearing of hear habeas corpus writs from Tuesday.
A meeting of the 19 SC justices held on Monday decided to hear all habeas corpus writs from Sunday. However, the meeting decided not to hear other writs except habeas corpus and not to attend the division bench with the Chief Justice Rana until he resigns from the posts.
SC justices had been boycotting all hearings including habeas corpus petitions for two weeks demanding resignation of the Chief Justice Rana alleging him of violating the code of conduct. Chief Justice Rana is alleged for seeking share in the government, delaying the hearing of cases filed against appointments to the constitutional bodies and many more.
It is said that SC justices have lately divided over the issue of boycotting the hearing for a indefinite period. The Disgruntle SC justice, who had still been advocating for boycotting all the hearing, compelled to come back in the hearing of the habeas corpus writs after some justice namely Kumar Chudal , Bam Kumar Shrestha, Prakash Dhungan and Kumar Regmi conducted hearing of habeas corpus writs from on Monday.
Though all the 19 SC justices had boycotted all the hearings including habeas corpus petitions, a meeting held between the Chief Justice Rana and representatives of the disgruntle justice had made agreement to resume the habeas corpus writs by separating benches with Chief Justice Rana.
We have decided to continue the hearing habeas corpus writs from Tuesday only if the benches were not shared with the Chief Justice Rana, a justice said adding that continuation of such strike would defame the judiciary.
As Chief Justice Rana has already made clear that he would not resign but face legal actions, the controversy emerged in the SC would not come into end soon if the SC judges remained with the stand that they would not hear all the cases unless chief justice resign from the post.
Political parties regardless of ruling allies or opposition represent in the parliament have been remaining mum over the issue of impeachment against Chief Justice Rana. It is said that the ruling head Nepali Congress and the main opposition CPN UML are against of the idea to impeach Chief Justice Rana.
