Kathmandu, Nepal, November15, 2022:The Supreme Court (SC), the apex court of the country, has issued an interim order in the name of the Election Commission (EC) on Monday not to implement its decision to remove the name of the LGBTIQ+ persons from the closed list of the proportional representation (PR) system of the November 20 elections.
Responding to a writ petition filed earlier, a single bench of Justice Dr Anand Mohan Bhattarai issued the interim order asking the EC not to implement its previous decision to remove the sexual minorities from the list.
As the EC had removed the names of 37 candidates, including 17 for the House of Representatives (HoR) and 20 for the provincial assemblies, whose gender identities were named differently in the closed list and in their respective citizenship certificates, the CPN (Unified Socialist) had moved to the court demanding interim order against of the EC’s decision.
The Party had listed Dilu Buduja, who has obtained citizenship with a third gender identity, in the party's PR closed list of candidates.
Similarly, the SC has also upheld its previous interim order validating the candidacy of Dr Toshima Karki, Rashtriya Swatantra Party candidate for the House of Representatives from Lalitpur Constituency number 3.
A joint bench of SC justices Ishwar Prasad Khatiwada and Til Prasad Shrestha issued the final verdict continuing the interim order while hearing the 'vacate' filed by the EC. Earlier, the EC had decided to invalidate her candidacy stating that she held a public post as an elected member of Nepal Medical Council (NMC).
Following the decision of the EC, Dr. Karki had moved to the SC demanding continuation of her candidacy. The EC had issued an interim order on November 1 asking EC not to immediately implement its decision to disqualify the candidacy of Dr Karki.
