Kathmandu, Nepal, July 30, 2021: As Mahantha Thakur has filed a writ petition at the Supreme Court (SC), the Apex Court of the country, on Friday against of the decision of the Election Commission (EC) for recognizing the Upendra Yadav and Baburam Bhattarai-led faction of Janata Samajbadi Party-Nepal as the authentic party.
Advocate Pradip Kumar Pathak filed the writ petition on behalf of Thakur demanding interim order not to implement the EC’s decision until the SC passes last verdict over the issue of division in the party.
Earlier Thakur had also filed a case against the EC’s process to recognize the party’s debate on the basis of headcounts of the central committee member. Responding to the writ, the SC had paved the way to the EC to settle the authenticity debate of the party on the basis of headcounts.
Following the verdict of the SC, the EC had on last Friday given authenticity to the Yadhav and Bhattrai led faction. Only 16 central committee members out of 51 had stand in favor of Thakur led faction.
Even though Thakur was the senior most chairpersons in JSP, which was formed in 2020 after a merger between his own Rashtriya Janata Party and Yadav and Bhattrai-led Samajbadi Party, he has now become party less from the EC’s decision. The EC has allowed the Thakur led faction to form a new party.
