Kathmandu, Nepal, September 28, 2021: President Bidya Devi Bhandari has repealed the ordinance introduced to bring some amendments in the Political Party Act 2073 BS at the recommendation of the government on Monday.
Following the recommendation of the cabinet, President Bhandari scrapped the ordinance on Monday evening. A cabinet meeting held earlier on Monday decided to recommend the president to scrap the ordinance, which was introduced to make easier to split the political parties.
As per the decision of the Council of Ministers and recommendation of the Prime Minister and Clause 2(b) of Article 114 of the Constitution of Nepal, President Bidya Devi Bhandari has scrapped the Ordinance on Political Parties (Second Amendment)-2078, states the press statement issued by the office of the president.
The government had introduced the ordinance on August 18 to amend in the Political Parties Act 2073 BS with the provision that party can be split if either 20 percent central working committee members or the parliamentary committee members opt to do so.
Following the ordinance, Madhav Kumar Nepal broke away the UML and formed the CPN (Unified Socialist) and Mahantha Thakur broke away the Janata Samajbadi Party and formed the Loktantrik Samajbadi Party.
Though the two parties had already technically divided, it was not formalized due to the legal provision that either 40 percent in the central committee or parliamentary party committee would be needed to split the party.
The main opposition, CPN UML had taken serious exception to the ordinance stating that it was aimed at splitting the party.
